Givvtmark Privacy Policy

Givvt Pty Ltd (Givvt, Givvtmark, we, our or us) is an Australian company that operates the Givvtmark mobile application, website and related services, including wishlist, board, product-saving, sharing and social gifting features (together, the Platform).

This Privacy Policy explains how we collect, use, disclose, store and protect personal information when you use the Platform.

By using Givvtmark, you acknowledge that you have read this Privacy Policy.


1. About Givvtmark


Givvtmark helps people capture, save, organise and share gift ideas. Users can create boards and wishlists, save products and links, follow or share boards, reserve gift ideas where available, and interact with content through the Platform.

Because Givvtmark includes account, social, sharing and product-saving features, some information you provide or generate through the Platform may be visible to other users or recipients depending on your privacy settings and how you choose to use the Platform.


2. Our Primary Legal Framework


Givvt Pty Ltd is an Australian company. Our primary privacy obligations are governed by the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

The Platform is currently in an MVP, or minimum viable product, phase. We are committed to handling personal information responsibly and in a manner consistent with applicable Australian privacy law.

Where the Platform is accessed by users in other countries, additional information is included in Section 17, International Users.


3. Information We Collect


We collect information that is reasonably necessary to provide, operate, secure, support and improve the Platform.


3.1 Account and Profile Information

When you create or use an account, we may collect:

  • name;

  • email address;

  • username or display name;

  • profile photo or avatar, where you choose to add one;

  • account ID or user ID;

  • login and authentication information;

  • account preferences and settings; and

  • information required to manage your account and access to the Platform.


3.2 Wishlist, Board and User Content Information

When you use the Platform, we may collect information you create, save, upload, share or interact with, including:

  • boards and wishlists you create;

  • board names, descriptions, dates, settings and visibility preferences;

  • items you add, save or Givvtmark;

  • product names, descriptions, prices, images, merchant links and related item details;

  • product-page URLs, merchant/source URLs and saved page metadata;

  • product search queries and product discovery activity;

  • notes, comments, likes, follows, reservations and other interactions;

  • public or shared board activity;

  • QR code or shared-link activity; and

  • other content you choose to submit, save, upload, publish or share through the Platform.


3.3 Photos and Images

We may collect photos, avatars, board images, item images or other images where you choose to upload or save them through the Platform.

This may include:

  • profile photos or avatars;

  • board images or icons;

  • item images;

  • product images associated with saved items; and

  • images selected from your device or captured through supported app features, where enabled.


3.4 Device, Technical and Usage Information

We and our service providers may automatically collect limited technical and usage information, including:

  • IP address;

  • device type;

  • operating system;

  • app version;

  • browser type, where relevant;

  • device identifiers or app instance identifiers;

  • session identifiers;

  • push notification tokens, where push notifications are enabled;

  • app interaction events, such as screen views, taps, app launches, board actions, item saves, follows, shares and reservations;

  • crash logs;

  • performance data, including launch time, app responsiveness, network performance and error data;

  • diagnostic logs;

  • approximate usage timestamps; and

  • security and fraud-prevention information.


3.5 Information We Do Not Currently Collect

During the current MVP phase, Givvtmark does not currently collect:

  • payment card details;

  • bank account details;

  • contribution, pooled funding or payout information;

  • government identity documents;

  • precise GPS location;

  • contact-book or address-book data;

  • health or fitness information;

  • sensitive information such as race, ethnicity, religious beliefs, political opinions, sexual orientation or biometric information;

  • credit information;

  • salary, income, assets or other financial information;

  • user phone numbers, unless we specifically ask for this information in the Platform; or

  • other user contact information outside of name, email address, username/display name and profile information, unless we specifically ask for it in the Platform.

If we introduce features that require new categories of personal information, we will update this Privacy Policy before collecting that information.


4. How We Collect Information


We collect personal information:

  • directly from you when you create an account, update your profile, create boards, add items, save products, comment, like, follow, share, reserve items or contact us;

  • automatically when you use the Platform;

  • from service providers that help us operate, authenticate, monitor, secure, analyse or improve the Platform; and

  • from third-party websites, merchants, browsers, share sheets, AI assistants or other external sources where you choose to save product or page information to the Platform.

Where you add product information from a third-party website, merchant site, share sheet, browser, AI assistant or other external source, we may collect the product information and source information you choose to save to your board or account.


5. How We Use Your Information


We use personal information to:

  • create, authenticate and manage your account;

  • provide wishlist, board, Givvtmark, QR code, sharing, following, reservation and social features;

  • display content and interactions you choose to make public or share with others;

  • allow other users to discover, view, follow or interact with boards, where permitted by your settings;

  • save and organise product ideas, product links, merchant information and related item details;

  • remember account settings and user preferences;

  • send essential service communications, including account, security, verification, policy and operational updates;

  • send board, wishlist, sharing, reminder or reservation-related notifications, where enabled;

  • analyse usage, performance and product functionality;

  • understand feature adoption and improve the Platform;

  • detect, prevent and respond to misuse, fraud, security incidents or technical issues;

  • provide customer support;

  • maintain technical reliability, security and availability;

  • comply with legal obligations; and

  • protect the integrity, safety and lawful operation of the Platform.

We do not sell your personal information.


6. Analytics, Diagnostics and Product Improvement


We may use analytics, crash reporting, performance monitoring and diagnostic tools to understand how the Platform is used and to improve reliability, functionality and user experience.

This may include collecting or processing:

  • app launches;

  • screen views;

  • taps, clicks and product interactions;

  • board, wishlist, item, follow, share and reservation events;

  • crash reports;

  • performance data;

  • device and app version information;

  • session data; and

  • diagnostic logs.

Where analytics or diagnostic information is linked to your account, device, session or user ID, we treat it as linked to your identity for privacy purposes.

We do not use analytics, crash data, performance data or diagnostic data for third-party advertising or data-broker purposes.


7. Tracking and Advertising


Givvtmark does not currently:

  • display third-party advertising;

  • sell personal information;

  • share personal information with data brokers;

  • use personal information to track users across third-party apps or websites for targeted advertising or advertising measurement; or

  • use names, email addresses, user IDs, product interactions, crash data, performance data or diagnostic data for tracking purposes.

If this changes, we will update this Privacy Policy and our relevant app store privacy disclosures before implementing those practices.


8. Marketing and Communications


We may send essential service communications, including account, security, verification, password, policy and operational updates. You cannot opt out of these while you maintain an account because they are necessary to operate the Platform.

During the MVP phase, we do not currently send non-essential marketing communications using app-collected personal information.

If we introduce non-essential marketing communications in the future, we will do so where permitted by law and provide a way to opt out.


9. Public and Shared Content


Givvtmark includes social, sharing and board-based features. Depending on your settings and actions, other users or recipients of shared links may be able to see:

  • your display name, username or profile photo;

  • public boards or wishlists;

  • items added to public or shared boards;

  • product names, product images, descriptions, prices and merchant links;

  • likes, comments, follows and reservations;

  • QR code or shared-link content; and

  • other information you choose to make public or share.

You should not add personal, sensitive or confidential information to public boards, comments or shared content.

Once information is shared publicly or with other users, we may not be able to remove all copies from third-party caches, screenshots, downloaded copies, external websites or other users’ devices.


10. Disclosure of Information


We may disclose personal information:

  • to service providers that help us host, operate, authenticate, analyse, monitor, secure and support the Platform;

  • to cloud hosting, infrastructure, database, analytics, crash reporting, monitoring, email, notification, authentication and customer support providers;

  • to other users where you choose to make content public, follow boards, comment, like, share, reserve or interact socially;

  • to recipients of shared links, QR codes, invitations or other sharing features;

  • to professional advisers, insurers, auditors or legal representatives where reasonably necessary;

  • where required or authorised by law, regulation, court order, government authority or enforcement agency;

  • to investigate, prevent or respond to suspected fraud, abuse, security issues, policy breaches or misuse of the Platform; and

  • in connection with a merger, acquisition, restructure, investment, financing or sale of all or part of our business, subject to appropriate confidentiality protections.

We require our service providers to handle personal information securely and only for the purposes for which we provide it to them.


11. Third-Party Websites, Merchants and Services


The Platform may include links to third-party websites, merchants, products, apps or services. This may include merchant product pages, retailer websites, affiliate or product links, external browsers, share sheets or product discovery services.

We are not responsible for the privacy practices, content, availability or security of third-party websites, merchants or services.

When you visit a third-party website or provide personal information to a third party, their privacy policy and terms apply.


12. Overseas Storage and Disclosures


Some of our service providers may store or process personal information outside Australia. This may include cloud hosting, infrastructure, analytics, monitoring, authentication, email, notification and support providers.

Where we disclose personal information to overseas recipients, we will take reasonable steps to ensure those recipients handle the information in a manner consistent with the Australian Privacy Principles, unless an exception applies under law.


13. Security


We take reasonable technical, organisational and administrative steps to protect personal information from misuse, interference, loss, unauthorised access, modification or disclosure.

These steps may include:

  • encrypted connections using TLS/SSL;

  • secure cloud storage;

  • access controls;

  • authentication controls;

  • monitoring and logging;

  • security reviews;

  • limiting access to personnel and service providers who need it; and

  • processes to detect and respond to security incidents.

No digital platform is completely secure. You are responsible for keeping your login details confidential and using strong account security practices.


14. Data Retention


We keep personal information for as long as reasonably necessary to provide the Platform, maintain your account, comply with legal obligations, resolve disputes, enforce our terms, prevent misuse and maintain security.

If you delete your account or request deletion, we will take reasonable steps to delete or de-identify your personal information, subject to:

  • legal, regulatory or accounting requirements;

  • backup and disaster recovery processes;

  • security, fraud or abuse-prevention needs;

  • unresolved disputes or investigations;

  • information required to enforce our rights or protect users; and

  • information already shared with others or made public through your use of the Platform.

Some deleted information may remain in backups or technical logs for a limited period before being securely deleted or overwritten.


15. Accessing and Correcting Your Information


You may access, update or correct certain account information through the Platform.

You may also contact us to request access to, or correction of, personal information we hold about you. We may need to verify your identity before actioning the request.

We will respond within a reasonable period and may refuse access or correction where permitted by law.


16. Account Deletion


If you create an account, you may initiate deletion of your account through the Platform where this functionality is available.

You may also contact us at privacy@givvt.app if you need help deleting your account or associated personal information.

When we receive a valid account deletion request, we will take reasonable steps to delete or de-identify your account and associated personal information, subject to the retention exceptions described in this Privacy Policy.

Deleting your account may not remove information that:

  • has already been shared with other users;

  • appears on public boards or shared links;

  • has been copied, saved or screenshotted by others;

  • must be retained for legal, security, fraud-prevention or dispute-resolution purposes; or

  • remains temporarily in backups or technical logs.


17. International Users


Givvtmark is operated by an Australian company and our primary privacy obligations are under Australian law.

We may make the Platform available in countries outside Australia through app stores or online access. If you access the Platform from outside Australia, you understand that your information may be collected, used, stored and processed in Australia and other countries where we or our service providers operate.


17.1 European Union and United Kingdom Users

We do not currently actively market or direct the Platform specifically at users in the European Union or United Kingdom.

However, if you access the Platform from the European Union or United Kingdom, we will handle your personal information in a manner intended to be broadly consistent with key privacy principles, including:

  • collecting information for the purposes described in this Privacy Policy;

  • collecting only information reasonably necessary for the Platform;

  • not selling your personal information;

  • not using your personal information for cross-app or cross-site tracking for advertising purposes;

  • allowing you to request access, correction or deletion of your personal information; and

  • taking reasonable steps to protect personal information in international transfers.

If our activities become subject to the EU General Data Protection Regulation or UK GDPR in the future, we will update this Privacy Policy accordingly.


17.2 California Users

We do not currently believe that Givvtmark meets the thresholds for the California Consumer Privacy Act or California Privacy Rights Act.

Regardless, we do not sell your personal information and do not share your personal information with third parties for cross-context behavioural advertising.

As we grow, we will monitor our obligations and update this Privacy Policy if we become subject to additional privacy requirements.


17.3 Other Jurisdictions

If you access the Platform from any other country, your use of the Platform is subject to this Privacy Policy and applicable Australian law, unless additional local laws apply.

We make no representation that the Platform is appropriate or available for use in all locations.


18. Children’s Privacy


Givvtmark is not intended for children under 9 years of age. We do not knowingly collect personal information from children under 13.

If you believe we have inadvertently collected personal information from a child under 9, please contact us at privacy@givvt.app and we will take reasonable steps to delete that information.

Users aged 9 to 17 should use the Platform only with the involvement and consent of a parent or guardian where required by applicable law.

If we introduce specific child, family or guardian-managed features in the future, we will update this Privacy Policy and any relevant consent processes before launching those features.


19. Complaints


If you have a concern or complaint about how we handle your personal information, please contact us at privacy@givvt.app.

Please include enough detail for us to understand and assess your complaint.

We will review your complaint and respond within a reasonable period.

If you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner at oaic.gov.au.


20. Changes to This Privacy Policy


We may update this Privacy Policy from time to time.

If we make material changes, we will take reasonable steps to notify you, such as through the Platform, by email or by posting an updated version on our website.

The updated Privacy Policy will apply from the date it is published or otherwise notified.
